Terms and Conditions for SantaFeStay

Welcome to SantaFeStay! These Terms and Conditions ("Terms") govern your use of the SantaFeStay website located at www.santafeshortrents.com and any bookings or reservations made through this website. By accessing this website or making a reservation, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
In these Terms, "Guest," "You," and "Your" refers to the person making a reservation or using this website. "SantaFeStay," "Company," "We," "Our," and "Us" refers to SantaFeStay and its owners, agents, and representatives. "Property" refers to the vacation rental accommodation booked through our website.
1. Reservations and Bookings
All reservations are subject to availability and confirmation. A reservation is confirmed only after you receive a booking confirmation email from SantaFeStay. The person making the reservation must be at least 21 years of age and will be considered the responsible party for the duration of the stay. The number of guests occupying the Property must not exceed the maximum occupancy listed for the Property. SantaFeStay reserves the right to refuse or cancel any reservation at its sole discretion.
2. Payment Processing via Stripe
All payments for reservations made through our website are processed securely by Stripe, Inc., a PCI-DSS Level 1 compliant third-party payment processor. By making a reservation, you agree to Stripe's Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy).
SantaFeStay does not store your full credit card number on our servers. Your payment card information is transmitted directly to and processed by Stripe using industry-standard SSL/TLS encryption.
Payment is required at the time of booking unless otherwise specified. The total booking amount includes the nightly rate, applicable taxes, cleaning fees, and any other fees disclosed at the time of booking. All prices are listed in US Dollars (USD). By providing your payment information, you authorize SantaFeStay to charge the total reservation amount, including any additional charges incurred during your stay (such as damages or additional fees), to the payment method on file via Stripe.
Refunds, when applicable, will be processed through Stripe to the original payment method. Please allow 5-10 business days for refunds to appear on your statement.
3. Cancellation and Refund Policy
Cancellation policies vary by property and are specified on each listing page. Please review the specific cancellation policy for your chosen property before completing your reservation. All cancellation requests must be submitted in writing via email to nmrealtorleland@gmail.com. Refunds for eligible cancellations will be processed through Stripe to the original payment method within 5-10 business days. No-shows or early departures are not eligible for refunds. SantaFeStay reserves the right to cancel a reservation at any time due to unforeseen circumstances, in which case a full refund will be issued via Stripe.
4. Check-In and Check-Out
Check-in and check-out times are specified on each property listing and in your booking confirmation. Early check-in and late check-out may be available upon request but are not guaranteed. Failure to check out by the designated time may result in additional charges. Check-in instructions, including access codes or key information, will be provided prior to your arrival. Guests are responsible for securing the Property upon departure, including locking all doors and windows and returning any keys provided.
5. Guest Conduct and House Rules
Guests agree to abide by all house rules specific to the Property, which will be provided prior to or upon check-in. General rules include but are not limited to:
No smoking inside the Property.
No unauthorized parties or events.
No exceeding the maximum occupancy.
Pets are only allowed at pet-friendly properties as designated in the listing.
Quiet hours must be observed as specified in the house rules.
No illegal activities on the premises.
Violation of house rules may result in immediate termination of the reservation without refund, and additional charges may be applied to the payment method on file via Stripe.
6. Damages and Security Deposit
Guests are responsible for the Property and all its contents during their stay. You agree to leave the Property in the same condition as found, aside from reasonable wear and tear. A security deposit or damage protection fee may be required for certain properties and will be disclosed at the time of booking. If damages exceed the security deposit amount, additional charges may be applied to your payment method on file via Stripe. SantaFeStay will provide documentation of any damages and associated costs. Any disputes regarding damage charges must be submitted in writing within 14 days of checkout.
7. Limitation of Liability and Assumption of Risk
To the maximum extent permitted by applicable law, SantaFeStay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses arising from your use of our website or services. SantaFeStay is not responsible for any personal injury, property loss or theft, or any other damages incurred during your stay. Guests assume all risk associated with the use of the Property, including but not limited to risks associated with fireplaces, hot tubs, pools, outdoor areas, wildlife, and altitude. SantaFeStay's total liability shall not exceed the total amount paid for your reservation. Nothing in this disclaimer will limit or exclude our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
8. Indemnification
You agree to indemnify, defend, and hold harmless SantaFeStay, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Property, breach of these Terms, violation of any law, or infringement of any third-party rights.
9. Force Majeure
SantaFeStay shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, pandemic, government actions, utility failures, or acts of terrorism. In such events, SantaFeStay will make reasonable efforts to provide alternative accommodations or issue a full refund via Stripe.
10. Intellectual Property
Unless otherwise stated, SantaFeStay and/or its licensors own the intellectual property rights for all material on this website. All intellectual property rights are reserved. You may access content from SantaFeStay for your own personal use subject to restrictions set in these Terms. You must not republish, sell, rent, sublicense, reproduce, duplicate, or redistribute content from SantaFeStay without prior written consent.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Santa Fe County, New Mexico. You consent to the personal jurisdiction of such courts. Before initiating any legal action, the parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
13. Changes to These Terms
SantaFeStay reserves the right to amend or update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
